These Terms of Service ("Terms") govern your access to and use of Flasharama.com and its website, application, software, content, features, and related services (collectively, the "Service"). The Service is operated by Flasharama.com ("Flasharama," "we," "us," or "our").

By creating an account, accessing the Service, or using the Service, you agree to these Terms. If you do not agree, you may not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.

Flasharama provides tools for creating, organizing, studying, and managing flashcards and related learning materials. We may add, modify, suspend, or discontinue features at any time. We may also impose limits on certain features or restrict access to parts of the Service if needed for operational, security, legal, or business reasons.

We work to keep Flasharama useful and reliable, but we do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

You must be at least 13 years old, or the minimum age required by applicable law if higher, to use the Service. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.

By using the Service, you represent that you meet these eligibility requirements and that your use of the Service complies with applicable law.

You may need an account to use certain features. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account, whether or not authorized by you.

You must notify us promptly at [email protected] if you believe your account has been compromised. We are not responsible for losses caused by your failure to protect your account credentials.

The Service may allow you to share decks or other content with other users or publicly. You are responsible for what you choose to share. Public or shared content may be viewed, copied, used, or redistributed by others, and we cannot control what others do with content after you share it.

We may remove, restrict, or disable access to User Content at any time if we believe it violates these Terms, creates legal risk, may harm users or the Service, or is otherwise objectionable.

We may investigate suspected violations and take action, including removing content, limiting access, suspending or terminating accounts, and cooperating with legal authorities where appropriate.

The Service, including its software, design, branding, logos, interfaces, features, text, graphics, and other materials, is owned by Flasharama or its licensors and is protected by intellectual property and other laws. Except for the limited right to use the Service under these Terms, we do not grant you any rights in the Service or our intellectual property.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the Service unless we authorize it in writing or applicable law permits it.

If you send us feedback, ideas, suggestions, or recommendations, you grant us the right to use them without restriction or compensation to you. We may use feedback to improve Flasharama or develop new products and services.

Some features may require payment or a subscription. Prices, billing intervals, included features, and renewal terms will be disclosed at or before purchase. By purchasing a paid plan, you authorize us or our payment processor to charge the applicable fees and taxes using your selected payment method.

Unless otherwise stated at purchase or required by law, fees are non-refundable. Subscriptions may renew automatically unless canceled before the renewal date. You are responsible for canceling subscriptions in accordance with the cancellation instructions provided through the Service or applicable app store or payment platform.

We may change prices or paid features prospectively. If required, we will provide notice before price changes take effect.

The Service may include links to third-party websites, tools, content, integrations, payment processors, authentication providers, analytics services, or other services. We do not control and are not responsible for third-party services or content. Your use of third-party services may be governed by separate terms and privacy policies.

Flasharama is a study and productivity tool. We do not guarantee academic, professional, licensing, test, or learning outcomes. Content created by users or generated through the Service may contain errors, omissions, or outdated information. You are responsible for verifying important information before relying on it.

The Service is not a substitute for professional, legal, medical, financial, academic, or other expert advice.

If Flasharama includes artificial intelligence, automated generation, recommendations, summaries, explanations, or similar features, those features may produce inaccurate, incomplete, offensive, or unexpected outputs. You are responsible for reviewing and verifying outputs before relying on them. You should not submit sensitive, confidential, regulated, or third-party personal information into AI or automated features unless you have the right to do so and understand the associated risks.

We may use inputs, outputs, and related usage information to provide, maintain, secure, and improve the Service, subject to our Privacy Policy and any settings or contractual commitments that apply.

You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, if we believe you violated these Terms, created risk or possible legal exposure, used the Service abusively, failed to pay fees, or if continued access would be harmful to us, other users, or the Service.

After termination, certain provisions of these Terms will continue to apply, including provisions concerning intellectual property, User Content licenses where needed for prior use or legal compliance, payment obligations, disclaimers, limitation of liability, indemnification, dispute resolution, and other provisions that by their nature should survive.

To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. Flasharama and its affiliates, licensors, service providers, owners, officers, employees, agents, and representatives disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, and course of dealing.

We do not warrant that the Service will be uninterrupted, secure, error-free, free of harmful components, or that content will be accurate, complete, or preserved without loss.

To the fullest extent permitted by law, Flasharama and its affiliates, licensors, service providers, owners, officers, employees, agents, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost data, loss of goodwill, business interruption, or cost of substitute services, arising out of or relating to your use of or inability to use the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to Flasharama for the Service during the three months before the event giving rise to the claim, or (b) $100 USD.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Flasharama and its affiliates, licensors, service providers, owners, officers, employees, agents, and representatives from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or relating to your User Content, your use of the Service, your violation of these Terms, your violation of law, or your violation of another person's rights.

These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of Tennessee, USA, without regard to conflict-of-law principles.

Before filing a claim, you agree to first contact us at [email protected] and try to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may proceed in the courts located in Davidson County, Tennessee, USA, unless applicable law requires another forum.

We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms, updating the "Last Updated" date, or using other reasonable methods. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

These Terms, together with the Privacy Policy and any additional terms presented to you, form the entire agreement between you and Flasharama regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our consent, but we may assign them as part of a merger, acquisition, sale of assets, reorganization, or by operation of law.
